1. INTRODUCTION

Turpin Communication, Inc., an Illinois corporation (“Turpin,” “we,” “us,” or “our”), is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your personal information when you visit our website at www.turpincommunication.com (the “Site”), subscribe to or use the eCoach Communication Toolkit, including the TurpinBot AI coaching feature (collectively with the Site, the “Services”), or otherwise interact with us.

This Privacy Policy applies to all individuals who visit the Site, subscribe to eCoach as an Individual Member, or are assigned a Seat under a Business Account. If you are an Administrator of a Business Account, this Policy applies to your own personal information; the eCoach Terms and Conditions govern your responsibilities with respect to the individuals you assign Seats to.

By using our Services, you agree to the collection and use of information in accordance with this Policy. If you do not agree with this Policy, please discontinue use of our Services.

We are the data controller responsible for your personal information for purposes of this Policy. You can contact us using the details in Section 14.

 

2. INFORMATION WE COLLECT

2.1 Information You Provide to Us

Contact and account information. When you fill out a form on our Site, sign up for our newsletter, contact us, or create an eCoach account, we collect information such as your name, email address, phone number, company name, and job title.

Account credentials. When you create an eCoach account, we collect a password and related security information used for authentication.

Payment information. When you purchase an eCoach subscription, payment is processed by our third-party payment processor. We do not store your full payment card number. We retain limited transaction information (such as the last four digits of your card, purchase date, amount, and subscription tier) for billing and recordkeeping purposes.

Business Account and Seat information. If you purchase or are assigned a Seat under a Business Account, we collect information necessary to administer Seats, including the Administrator’s contact information and the names and email addresses of individuals assigned Seats.

Content you submit. This includes testimonials, comments, course feedback, and any other information you voluntarily provide to us.

2.2 Information Collected Through TurpinBot

If you use TurpinBot, our AI-powered coaching feature, you may record audio and/or video of yourself practicing presentations, meetings, or conversations. These recordings, along with any resulting transcripts, written feedback, or AI-generated analysis (collectively, “AI Content”), are processed on our behalf by our third-party technology partner, Yoodli, Inc. (“Yoodli”).

AI Content is used to provide you with coaching feedback and to operate and improve the TurpinBot feature. Yoodli’s handling of your AI Content is also governed by Yoodli’s own Terms of Service and Privacy Policy, available at yoodli.ai. We encourage you to review Yoodli’s policies, as they describe Yoodli’s own data practices, which operate separately from, and in addition to, this Policy.

Recordings of other people. If your use of TurpinBot captures the voice, image, or statements of any other person — for example, a colleague in a recorded meeting — you are solely responsible for obtaining any consent required by applicable law before making that recording. Please see the eCoach Terms and Conditions for more information about your obligations when recording third parties.

2.3 Information Collected Automatically

When you visit our Site or use eCoach, we automatically collect certain technical information, including your IP address, browser type, device characteristics, operating system, referring URLs, pages viewed, and the dates and times of your visits. We use this information to operate and secure our Services and for internal analytics.

We and our service providers also use cookies and similar tracking technologies. See Section 5 below.

2.4 Information from Other Sources

We may receive information about you from third parties, such as a Business Account Administrator who provides your name and email address to assign you a Seat, or a co-marketing partner with whom we host a joint webinar or event.

 

3. HOW WE USE YOUR INFORMATION

We use the information we collect for the following purposes:

  •       To provide the Services, including creating and maintaining your account, administering Seats, providing access to eCoach content, and operating TurpinBot.
  •       To process payments and manage subscriptions, renewals, and billing.
  •       To communicate with you, including responding to inquiries, sending account and service-related notices, and, with your consent or where otherwise permitted, sending marketing communications about our training, resources, and events.
  •       To improve our Services, including analyzing usage trends and evaluating the effectiveness of our content and marketing.
  •       To maintain security, including detecting and preventing fraud, abuse, and violations of our Terms and Conditions.
  •       To comply with legal obligations and respond to lawful requests from public authorities.

We process this information on the basis of performing our contract with you (such as providing the Service you subscribed to), our legitimate business interests (such as improving our Services and keeping them secure), your consent (such as for marketing emails), and compliance with our legal obligations.

 

4. HOW WE SHARE YOUR INFORMATION

We do not sell your personal information for money. We share information only in the following circumstances:

  •       Service providers. We share information with vendors who perform services on our behalf, including payment processing, email delivery, website hosting, and analytics. Our use of Yoodli to provide TurpinBot is described in Section 2.2.
  •       Business Account Administrators. If you are assigned a Seat under a Business Account, your Administrator can see your name, email address, and Seat status (active, assigned, reassigned) for administrative purposes. Administrators do not have access to the content of your individual course activity, downloads, or TurpinBot recordings, transcripts, or feedback.
  •       Legal compliance and protection. We may disclose information where required by law, in response to legal process, or where we believe disclosure is necessary to protect the rights, property, or safety of Turpin, our users, or others.
  •       Business transfers. If we are involved in a merger, acquisition, financing, or sale of assets, your information may be transferred as part of that transaction, subject to this Policy or a successor policy.
  •       With your consent. We may share information for any other purpose disclosed to you at the time you provide it, or with your consent.

We may share aggregated or de-identified information that does not identify you with third parties for any purpose.

 

5. COOKIES AND TRACKING TECHNOLOGIES

We and our service providers use cookies, web beacons, and similar technologies to operate our Site, remember your preferences, and understand how visitors use our Services. This includes analytics cookies (such as Google Analytics) that help us understand traffic and usage patterns.

You can control cookies through your browser settings. Most browsers let you block or delete cookies, though doing so may affect the functionality of our Site. Where required by applicable law, we will request your consent before placing non-essential cookies and will provide a mechanism for you to manage your preferences.

 

6. HOW LONG WE KEEP YOUR INFORMATION

We retain personal information for as long as necessary to provide the Services and for legitimate business purposes, such as maintaining business and financial records, complying with legal obligations, resolving disputes, and enforcing our agreements.

eCoach account data. We retain account data, course progress, and TurpinBot AI Content for as long as your subscription is active. If a Seat is reassigned to another individual, the previous Seat holder’s account data, including TurpinBot recordings and history, is permanently deleted in accordance with the eCoach Terms and Conditions and is not recoverable.

General retention. Where we have no ongoing need to retain personal information, we will delete or de-identify it, except where longer retention is required by law (for example, tax and accounting records).

 

7. HOW WE PROTECT YOUR INFORMATION

We use commercially reasonable technical and organizational measures designed to protect your personal information. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

 

8. CHILDREN’S PRIVACY

Our Services are intended for business professionals and are not directed to individuals under the age of 18. Consistent with the eCoach Terms and Conditions, you must be at least 18 years old to create an eCoach account. We do not knowingly collect personal information from anyone under 18. If we learn we have done so, we will take steps to delete that information.

 

9. INTERNATIONAL USERS

Our Services are hosted in the United States. If you access our Services from outside the United States, your information will be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your country.

 

10. YOUR PRIVACY RIGHTS

10.1 All Users

You may contact us at any time to ask us to access, correct, or delete the personal information we hold about you, or to opt out of marketing communications. You can unsubscribe from marketing emails using the link in any email we send, or by contacting us directly. We will still send you service-related communications necessary to administer your account.

10.2 European Economic Area, UK, and Other Regions With Data Protection Laws

If applicable data protection law gives you additional rights, you may have the right to: request access to your personal information; request correction or deletion of your personal information; restrict or object to our processing of your personal information; and receive a copy of your personal information in a portable format. Where we rely on your consent to process your information, you may withdraw that consent at any time. If you believe we have not complied with applicable data protection law, you may lodge a complaint with your local supervisory authority.

10.3 California Privacy Rights

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, “CCPA”), gives you the following rights with respect to your personal information:

  •       Right to know the categories and specific pieces of personal information we have collected about you, and the categories of sources, purposes, and third parties involved.
  •       Right to delete personal information we have collected from you, subject to certain exceptions.
  •       Right to correct inaccurate personal information.
  •       Right to opt out of the sale or sharing of personal information. We do not sell personal information for money. We do not believe we “share” personal information for cross-context behavioral advertising as defined under the CCPA; if this changes, we will update this Policy and provide an opt-out mechanism.
  •       Right to limit the use of sensitive personal information to purposes permitted under the CCPA. Depending on how you use the Services, this may include certain account and authentication information.
  •       Right to non-discrimination for exercising any of these rights.

To exercise any of these rights, contact us using the information in Section 14. We will verify your request before responding, as required by law.

We do not knowingly sell or share the personal information of consumers we know to be under 16 years of age.

 

11. THIRD-PARTY LINKS AND SERVICES

Our Site and Services may contain links to, or integrate with, third-party websites and services, including Yoodli (for TurpinBot) and our payment processor. This Policy does not apply to those third parties, and we encourage you to review their privacy policies directly.

 

12. CHANGES TO THIS POLICY

We may update this Policy from time to time. The “Last Updated” date at the top of this Policy reflects when it was last revised. If we make material changes, we will notify you by posting a notice on our Site, sending an email, or other reasonable means. We encourage you to review this Policy periodically.

 

13. eCOACH TERMS AND CONDITIONS

Your use of eCoach, including TurpinBot, is also governed by the eCoach Terms and Conditions, which contain additional provisions regarding account use, Seats, intellectual property, and your responsibilities when recording third parties. In the event of a conflict between this Policy and the eCoach Terms and Conditions, specifically with respect to data handling, this Policy controls.
